Approximately 30 million people in the UK who bought an Apple Inc. and/or Samsung Electronics smartphone between the year 2015 and 2024 might be entitled to around 17 pounds per claimant should a consumer campaign group prevails in its case against the American tech giant Qualcomm.
Trial Commences This Week
The campaign is escalating the technology corporation to the Competition Appeal Tribunal in London now.
The legal proceedings involving the consumer group and Qualcomm is projected to last over a month.
The organization is accusing the tech firm of unfair competition.
The allegation is that the firm forced Apple Inc. & Samsung to pay excessive costs and royalty payments for critical handset components, which then raised the expense of those devices for buyers.
Key Points the Legal Action Will Examine
The trial beginning now will examine whether Qualcomm possessed control and, should that be the case, whether it abused a powerful stance.
If the watchdog is successful in its claim, there will be a second stage seeking £480 million from the tech firm, to be distributed among an projected 29 million British consumers affected.
The body is claiming compensation for all impacted Apple and Samsung handsets purchased between the start of October 2015 and January 9, 2024.
The organization states this would almost certainly amount at about £17 per individual.
Past Allegations and Qualcomm's Position
The chipmaker has previously claimed the claim has "no foundation".
A parallel legal action against Qualcomm is ongoing in Canada, and the corporation has also earlier been penalized by the European Union for antitrust breaches.
The Federal Trade Commission in the America sued the company for anti-competitive behavior in the way it sold rights to its patents during 2017, but had its claim dismissed in the year 2020.
Significance of the Legal Action
The head of the organization remarked: "This trial is a significant event. It illustrates how the influence of consumers - supported by our organization - can be used to require the largest corporations to answer should they abuse their leading role."
Qualcomm is one of the largest global suppliers of mobile processors and has faced claims about unfair practices previously.
